Well, there you go, a case that has no actual child porn involved, so you must judge it purely on animated content. I wonder what it was he watched, and I'm glad I'm not from Canuckistan.

Also "any representation of underage people's genitals is illegal under the Criminal Code." means you could draw crude stick figures and definitely be in violation of the law.

Was he even watching lolicon, or is this just an arbitrary decision based on the misconception that all hentai depicts children?

Yeah, there's not much that really depicts actual child-like looking children, maybe those 80s lolicon animations or a few scattered recent titles, but a good number from the 80s to now that would involve underaged teenagers, which is the same thing under the law.

So if you have a young child that unwittingly draws a depiction of themselves naked in the bath tub, you might get charged if you don't immediately destroy the picture.

I live in Canada and I know for a fact that there are still stores here that sell/rent hentai (no first hand experience, no pun intended). I really hope this guy didn't go down for "normal" hentai. Otherwise I suppose lots of people are breaking the law up here. No more school girl fantasies. :'(

I can understand this if he'd done something with a real child. Or, you know, looking at pictures or videos with real kids. Because the latter easily could've been forced, and that's not right. But this is anime. It's not real. It's not negatively affecting children. I GUESS you could argue that people who want hentai could potentially want to start watching real porn or whatever. But if you stay limited to 2D, things that aren't real and not harming anyone, I don't see what the problem is.

^Exactly. Maybe keep an eye on him or even do a psych eval if you must, but this is extremely excessive and rather scary.

Thats nice. How is that relevant to his question though? Even if you consider everyone under 18 to be a child, there are hentai that depict people older than 18. The article seems to imply that hentai = child porn which isn't true.

Honestly, I don't even know how you can judge that unless somewhere in the work an actual age for a character is stated. I don't see how in most cases that can be anything but guessing based on how old a person in a drawing 'looks', and assuming a girl is actually how old they look will get you in a lot of trouble in the real world, so I don't see why anyone would want to run with that method with drawings.
