Kinda ironic considering the business that 5pb and Nitroplus is in. They should've just asked for a cut!

Except that 5pb doesn't do any adult visual novels.

I wonder what scenes in the movie violated copyrights with the series.

Keep in mind this is Japan. Their ideas and laws on fair use probably differ a bit.

It only said portions were misappropriated copyright infringement...

I'm wondering what portions of the video copied...Was it content used from the anime or what? The logo? Dr Pepper? The original scripting of the anime/game?

Since they haven't said in detail, it seems strange.

They also have a Fate/STAY Night parody AV and that's been around for a long time.

As far as "Fair Use" goes, Karisu has a point with CR laws, but I don't think the fair use was the issue. There's been TONS of AV parodies of plenty of anime out there, and if that was the case, I couldn't see doushinji surviving anymore.

Doujinshi survives because it's all done by fans/amateurs. It's not corporate or commercial. A few hundred or maybe a thousand copies of a doujinshi made to sell at Comiket at a price so that the doujinshi author breaks even or perhaps makes a modest amount of money isn't a big deal to Japanese execs. However, if they were to publish such content at a much wider scale then it would get cracked down on really quick.

Correct. Japan doesn't have fair use at all. This is why Japanese wikis rarely have pictures at all.

However, Japan usually doesn't enforce the laws at all, which is why doujinshi and things like all those MADs/anime videos on NicoNico can exist.

edit: and after viewing some other side-by-sides, it's clearly going a little bit... beyond... "parody"

it's scene by scene almost identical. for serious, darn they did a good job copying the show.
