I got a C&D back in 2009 from Funimation. What was so confusing about it to me, is that they could've only known I was doing that if they were sharing the file as well. Wouldn't that have counted as them GIVING me the file? I was a jerk and didn't even have uploads enabled so I wasn't even really "Sharing" so much as "receiving"

No, you only have to be on the torrent to see what others are doing. You don't have to be sending any file data (and it's very easy to create a client which will do that). What you can't see is who is sending what to who, which is the argument this judge is making, and thus you can't prove any two users are conspiring, even if it's clear they are uploading data.

Interesting. Didn't know Funimation was still doing lawsuits, since the last time.

Not unless Funimation is involved with independent movies Killer Joe, Sibling and The Company You Keep which the ruling is about.
