You can get clone consoles/SoAC consoles/whatever you want to call them here in the US just without games, you got to download those yourself. Can't the Japanese police go after compensated dating which is bad instead of emulation and clone consoles which are harmless and Nintendo doesn't lose a cent from.

This one DID come with games, though, and it so happen to coincide with Nintendo's release of its own mini console preloaded with games, so... whatever I might think of Nintendo personally, they had every right to stop this guy.

Even if Nintendo doesn't lose a cent from these things it's still illegal. That's slippery slope logic.
