Matsumoto may have been declared legally wrong, but Makihara's the greedy one in this case for asking for compensation.

The guy was defamed in public. I would have attempted to take him to the cleaners too.

Seems pretty damn close to me, but whimsical speech like that is pretty interchangable and Matsumoto shouldn't have gone after this. I hope he isn't becoming an curmudgeon in his age.

Leiji Matsumoto should have won, not the otherway around. I can't blame him for suing, I sure wouldn't want my work plagiarised.

Man, Matsumoto has poor luck with the courts.
Also, please read the original article.
All Matsumoto wanted was an apology, it's this "musician" that wanted the ¥¥¥¥¥¥¥¥.

I have to agree ... poor Leiji. Him and the courts don't mix ...
But you think that the band is probably in the hell now. So many leiji fans are going to turn on them. If I was them (and of course I didn't do it) I would have just gone to court (if necessary) but just say at the end, "Just because one person made a mistake doesn't mean that I have to punish them." And of course I wouldn't have asked for money ...
But the lyrics ARE really similar ...

And how many viewers heard watched that broadcast?
It was on TV that Matsumoto smeared that artist. It could have hurt sales of the artist's CDs, ruin his rep. and ended his career. If Matsumoto was that concerned, he should have spoken to the band privately.
If you take something like this publically, you should be ready to receive a lawsuit even if the artist loses in the end. If the artist didn't sue, it would have been an admission of guilt.

Interesting. I really can't agree with this. I suppose Matsumoto was wrong for publicly accusing someone of something without proper legal backing but the lyrics look fairly similar to me. After Matsumoto failed to get his apology he should have sent the music label a C&D letter and tried to get some sort of injunction barring album sales. He probably would have received an apology at that point, forced by the record label. If not he could let the courts decide it from there. The article says "The judge did not rule on whether any plagiarism had taken place because Matsumoto had given up his right to demand compensation in the lawsuit" but he's still entitled to credit for his work and I doubt this case is over but he'll have to pay this round.

Wow. seems to me Matsumoto should clearly have won. The idea is exactly the same even if the words were changed around a bit.
It seems impossible to me that this isn't a clear case of plagiarism unless the idea expressed here is so common to Japanese culture that it could easily have occurred to different artists. Poor guy, he needs a better lawyer.

Copyrights only protect the expression of an idea, not the idea itself. This allows for the same idea to be expressed in as many different ways as humanity's capacity for creativity will allow.

The situation totally didn't seem like it required a lawsuit. That is unless Matsumoto really said something hurtful, which I find extremely doubtful.

Hmm, well reading the lines I can only say that they sound pretty meaningless. There is an inversion there that makes a statement that makes sense into one that doesn't (to me).
In any case, I think making a plagiarism claim on TV in front of a lot of people for 2 lines without ever talking to the party in question is pretty reprehensible. It may not be 24000$ in worth, but it's still wrong unless he talked to them and had some reason to believe it. It's not like either of those lines is particularly special or noteworthy.

It`s not the first time I`ve heard about Makihara getting into something that deals with the legal system. He`s had drug problems too.
