It's very obviously a joke, and people egging him on are from Japan, who have no clue what fair use is. While you could argue that using art as a meme is a violation, it should be transformative enough to be covered by fair use.

If he could actually sue for posting meme's, that would open it up for everyone to be sued for posting meme's and retweeting them too.

There is precedent for suing someone over meme usage. There was a video game called Meme run than got taken off the Wii U e-shop because, allegedly, the owner of the 'trollface' meme sent a DMCA to Nintendo because the meme was in the game w/out his permission.

In general, copyright is more about whether or not the owner is actually bothered. You can have a genuine claim to copyright but choose not to sue. For example, because of bad PR.

Leaving aside the specifics of who's posting it (and the fact that this is obviously a joke, although the annoyance is probably genuine), I think there is a real argument to be had (certainly ethically and possibly legally) about turning a piece of someone's work into a widely disseminated symbol without their permission. Yes, a successful case could lead to a crackdown on meme templates, but that doesn't strike me as a hill worth dying on.

Edit: Early-morning me is an idiot who tries to take everything way too seriously.

Sato isn't getting a single yen from Musk, fair use is king in Twitter's homeland, the draconian legislation on copyright in Japan doesn't apply here.

It's definitely a hill worth dying on, since banning (free) meme templates would undermine fair use laws. That would kill reviewing media as a business among other things.

Knowing how thin skin Musk is since he banned parody accounts that pretended to be him and made fun of him, i wouldn't be surprised if Musk would do the same thing with Sato's account.
