If the girlfriend has a ton of cash then they'd probably try. Anyway, I don't understand this case. The fiancee had no reason to expect fidelity or that their relationship would last considering that she knew that he was married while he was seeing her. Don't have a relationship with a married person if you want someone who will actually be faithful to you, because, they're already cheating on their spouse by dating you. |

As noted, there's NOTHING so far implying a statutory situation. And there's ZERO reason to assume one. The standard duration of a pregnancy is 9 months if the girl was 20 and "accidentally" pregnant, why would you assume that he had to start something while she was underage? I mean, at CRAZY maximum (ridiculously extended pregnancy) she had to have been at least 19 when she got pregnant. Supposedly Otogi was born at the end of 1995, so this would have had to be a REALLY long running thing for him to have been shagging a minor. |

To answer this question and others, after a quick search about Common Law Marriage, I found this. http://oharalaw-japan.com/2017/04/12/common-law-marriage-japan/ If this information is true, then it would make more sense. I wonder if anyone can locate any official documents or site with this type of information on it as running additional searches about this don't really bring up much of anything. |

Going by the idea that this was a common law marriage. The idea that he left and took everything but the two cats he left, without her knowledge while she was away, makes her case a bit stronger. Even with common law, their is still that shaky grey area about equitable division of assets, which he clearly didn't follow with a surprise departure.
Regardless of the legal aspects, he still sounds like a total scumbag and coward. Everything he's been accused of just makes him sounds like a completely terrible person and I don't blame the women for wanting some justice for her mental anguish. Then again, considering what he did to Oh My Goddes! it's not a surprise. |

Common law marriage, as far as I understand, typically requires a set amount of time together. Fujishima didn't divorce until 2014, so that's the earliest the common law time could start with his fiancee. He left the fiancee in summer of 2016, so that'd be a total of about two and a half years? Most common law marriage that I'm familiar with requires at least 3 years, and usually 4-5, but I'll admit to not knowing anything about Japanese law in this respect.

What you are saying is supported by the fact that she is apparently not claiming common-law-marriage but mental anguish. In those few jurisdictions in the US where common-law-marriage is still recognized it is not enough to just live together. Usually you have to hold yourselves out as husband and wife to both neighbors and the community at large. This would include signing leases together and possibly combined finances. |

This is why we never get to see what happens after the end of a romcom, whether best girl wins or not, it is bound to get ugly (not school days ugly nonetheless) and get some lawyers in and it becomes a disaster.

Okay, this article cut out so many details its causing severe misunderstandings (ANN, shame on you for letting this fly.)
Fujishima's former wife and him had been separated for years, before he met the previous fiancée in question. But because their child was not an adult yet, they held off on an official divorce, but they lived separate lives. Japan is different from the US, and having divorced parents can cause a lot of issues for kids, especially social-wise. Anyways, he continued on with his relationship with the former fiancée, promising to marry her after he was able to legalize his divorce. She believed that. Fast forward sometime down the line, and Fujishima finally divorces his previous wife now that their child is an adult, but doesn't immediately move toward marriage towards the girl. And then there's the whole deal about how Fujishima was rumored to be messing around with Otogi a full 2 years before they married and...yeah. Also, regardless of age of consent in Japan, you are not a legal adult until you are 20. So they were really... on the edge of him getting her pregnant just barely being legal without facing legal repercussions (although socially, he has already faced a lot of backlash since. And now this new deal is definitely going to be affecting his future work.) |
