theyve had the digital license for awhile now I believe for 3yrs, correct me if I'm wrong it's a partnership between Square Enix and Yen press to release all there catalog in the west so they could release it faster.

Very simple, they haven't. The correct answer is VIZ only has the rights to the "physical releases", while Yen Press has the rights to the "digital releases".
It does explain why this is not part of Viz's digital releases, though ironically Viz is also a member of ComiXology.
