That would probably only happen if Lego makes it an official set. Besides, it would be Lego that would get the C&D letter if anything since they'd be the ones selling the set. Plus, that would also only be in places where HG has the Robotech name.

If LEGOS does it, they'll get hit with it. IF it comes to the United States, Japan? They don't have worry about it.
HG want their money, that what it comes down to. Plain and Simple. Mizers milking their IP is what they live for while they sell Real estate in LA.

Harmony Gold has no say about what happens in Japan in regards to Macross or any other countries that they never released Robotech in.
The only thing that HG can really do is block the set from being sold in the countries where it has the Robotech license unless Lego goes ahead and obtains a license from HG to sell it in those particular countries.

Which brings up the question, how expensive are they? There allot flak that keep being thrown around when someone brings it up. Hasbro did that with their Jetfire/Gi-Joe Striker jet that look like crappy VF-1J from Macross Movie.

As far as I know, unfortunately Harmony Gold trademarked the name Macross in the USA, Canada, Germany, and the United Kingdom. So Lego will have to at the very least not include those countries in it's merchandising plan.

That's only if Lego chooses not to obtain the licensing rights to sell the set in those countries.

I don't think it's going to happen, and not solely because of Harmony Gold... instead, look at the competition. It's going up against Adventure Time!, Legend of Zelda and Sherlock. I'm afraid that more people are going to vote to have a minifig-Benedict Cumberbatch than are going to vote for an awesome mecha... from a show 32 years old
Although, the fact that none of them have a rather pathetic real-estate company with delusions of media-empire grandeur sitting on any chance of bringing it to the American toy market might be a nudge in one of the other directions as well...
