I have seen a lot of disturbing things with anime characters on the internet by fans then any show in television. So,I was just wondering are the copyrights laws are weaker in Japan then in America or are the people who has the rights to the anime just do not care?

What exactly does copyright have to do with how characters are treated in a show? Plus, there is plenty of sex and violence on American TV alone. |

I think a more important worry would be dojinshi - especially pornographic dojinshi. I assume the companies either can't or don't want to do anything about it and I guess it is all part of the fandom surrounding a series.
I know nothing about copyright law anyway... But I could see how a company may have concerns about their brand being damaged. |

Well, A LOT of homemade videos out there involving characters are technical violation of copyright, but companies will leave them alone (not all the time, some companies do pursue and are pretty hot headed about these things) as they promote their series in a certain way. And are you referring to MUGEN? |

Also, can they not get in trouble it they say unoffical or say that the company that made the anime did not endorse this product.

That doesn't make a difference, as they're still using the material without the permission of the copyright holder (or intellectual property rights holder). It's just that it seems that the companies don't care, for the most part. |

Well, saying the companies don't care is a bit of a stretch. In some events we've seen companies on both sides of the ocean make moves to protect their copyrights. The primary issue is whether it's worthwhile. Most don't take fanart and fanfiction to seriously in regard to the official story, so there's no real impact there and it's not like the fans are profiting off them big time either. On the other hand it costs the company money to pursue the legal issue so in many cases it's just not worth it for them to go after those artists.

09812 was talking about niji sousaku (二次創作), or "derivative work" in United States Code.
I think I've pretty much explained it in my two previous posts here and here. |

Most American(foreign) otaku steal anime and manga from Japan. Most people in ANN steal anime and manga somewhere else and talk about them but they act as if they were innocent. I don't know why they can complain about what they have stolen. There are a lot of images without permission in ANN. Perhaps most avatars are illegal for the same reason. Do you think those mean the laws in Japan is weaker than in the US? |
