...wow that is one lucky kid if he was teenager at least.

All joking aside this is nothing compared to the creepy junior idol videos they are still making or the soft-core underage porn from the 80's-90's of real 13-15 year old girls.

Edited for my own reasons.

Something about underage boy touching bare breasts seems like it should have been fairly obvious it wasn't a great idea to start with.

We all know how well that went when that mother of that 4-7 y/o who posed for a photo shoot when she was still breastfeeding him went...

(Photo was of the boy sucking on her exposed breast, no nipple, of course.)

Poor bewbs are always in trouble Sad

I wouldn't say the boy is lucky. Depending on his age, which appears to ten or less, there is a certain level of exploitation in the image.

The boy hasn't been identified as Tomomi Kasai's child, where perhaps a similar photo could of invoked a feeling of vulnerability, closeness, and purity if done correctly. A nude woman and child together doesn't have to be sexual. Instead, we have this photograph. Kasai's expression on her face, a half-smile reads more provocative without stepping into overtly sexual territory.

If you also take into consideration the other types of photos included in the book (lingerie, bathing suit), the purpose of the image collection and its selling point is likely risque/sexy photos for fans of Kasai's good looks. A child doesn't belong in an image collection of that nature.

It's possible that Kasai was wearing pasties during the photo shoot, so the boy never actually touched her nipples, but to reiterate: they probably used a child because if the hands were an adult male, fans would be upset. But the photo's intention is the same. The child was used as a stand-in for an adult. I hope his parents were at least there to supervise, although it doesn't ease my personal concerns with the image at all.

It's fairly hilarious because the picture is completely non-erotic. It's even a satire of all those erotic pictures out there of a grown man obscuring a woman's breasts in the same manner. This is just another fine example of the insanity that rests behind the eyes of the forces of censorship. Modern culture's sexualization of the breast, the tacit declaration that any woman's body is public property, and the public (who are without exception the censors who are in power) who determine what any woman can do with her body, are the conspiracy that will continue to undermine the freedom and individuality of half the population of this globe. The sickness is in those who see sickness wherever they look. I really think that picture is funny. I made sure to capture it before Anime News Network gets shut down for child pornography in the USA. (Yes, I'm joking, but no, I'm not.)

well maybe not lucky should have been the word I choose but I was just being honestly blunt. I would also agree that a child doesn't need to be in sexy photo's of kasai because from a modeling stand point she can do this just fine. I really don't want to dwell more on the subject due in part I've seen things far more disgusting that is actually legal for junior models to do, most are same age as kirino from oreimo this has left me mentality scared. So thank you internet =_=.

The kid unfortunately doesn't know how lucky he is. Now, if he were 13 or older, then yeah, he'd definitely be cherishing the moment and will remember the delightful squishy and nibbly feeling in his hands forever Laughing

Shut up, please. There aren't many things that offend me, but joking about molestation really isn't appropriate.

Also, why is ANN linking to a potentially illegal image? WTF?

(edited for accuracy)

Tōru Okumura, a lawyer familiar with child ponography issues, explained that the legal issue is over a male minor touching a female's nipples. In his opinion, the photograph would have been "safe" if the minor was touching her breasts, but not her nipples. If that were the case, he said that it would not be legally considered child pornography in Japan — even if the nipples were exposed.

You know how really stupid that sounds?

So, basically, he could've gone the whole ten yards on her breasts, not touch her nipples, and everyone would still be fine? What?

That's as ridiculous and laughable as the picture itself (which, IMO, is more poorly-artistic than erotic, though I don't condone it either way). This has tasteless skit/parody anime written all over it… (Then again, Magi sort of beat them to it…)

Apology accepted.

I mean, I get where you're coming from, what dude wouldn't appreciate being that position. But being photographed like that before you've reached sexual maturity is just exploitative, and hearing people joke about that . . . well, I don't care for it.

See? Now things like this is totally wrong. The kid isn't having sex with the woman, so it's not sex and it's not statutory rape...

I can only imagine how you reacted to that Time magazine cover of that women breastfeeding her kid, like I mentioned.

Breastfeeding a child is not comparable to this image in purpose or target audience.

Edit to add: Statutory rape laws vary state to state. Going by Washington State law, the image could fall into the following categories if an argument is made that the image's purpose is to illicit a sexual response from the viewer:

RCW 9.68A.100: Commercial sexual abuse of a minor
http://apps.leg.wa.gov/RCW/default.aspx?cite=9.68A.100 where sexual abuse includes both sexual intercourse or sexual contact.

Where as "sexual contact" is defined under RCW 9A.44.010 as:
"Sexual contact" means any touching of the sexual or other intimate parts of a person done for the purpose of gratifying sexual desire of either party or a third party." Third party would fall under the book's audience in this case.

blarg01: You're correct, my terminology was incorrect. I'll edit my post.

I haven't seen the image, because it may be illegal (as the news post mentioned), so I probably shouldn't have commented on it. But the jokes I objected to called the child 'lucky', implying that he could 'enjoy' the position he was put in for the picture - and thus, that there was something sexual about it. It was the joking about a child having a sexual experience with an adult that I found offensive.

Like any statutory offense or offense by fiat, statutory "rape" laws defy rationality. It isn't rape for if it were, it wouldn't be statutory. It isn't objective for if it were, it wouldn't vary place to place, and would be provable, neither would it deal with intent (making it a thought crime), but if that were the case, it again wouldn't be a statutory offense to begin with.

He most certainly would have, had he reached puberty, hence my joke about what he doesn't know he's missing.

It's not sexual from the kid's perspective because he hasn't reached puberty, and is actually rather innocent, but it's sexual from the magazine's reader's perspective--which would include a large amount of teenage males, btw--and it is this dichotomy that makes it amusing. But you know what I find offensive? All the people who take grave offense at this--this photoshoot that his parents obviously did not find offensive themselves.
