Yeah, I do get why they're doing this. Companies mess-up all the time, and FUNi happens to be the biggest of said companies, so their mess-ups get the most scrutiny... but I do have to wonder: are most of the people complaining about this even looking at this fairly? I mean, if you're only buying the DVD for a bunch of non-continuity OVAs that have little impact on the story (or so I've heard)... I would seriously re-consider your purchasing habits, and those are likely the people doing the most vocal complaining.

So yeah, good on them, but the fandom affected should look at themselves for a moment as well.

It doesn't matter what the show is or what the OVAs are, you don't goddamn lie to your customers.

Like walw6pK4Alo, they lied to the customers. That's actually completely illegal. It's called false advertising.

The problem obviously isn't that the OVAs are not there, it's that they said they WOULD be there. Its like saying a video game comes with a DLC pack but then you find out after you buy it that it was a "clerical mistake" and that you DON'T get the DLC. In that case chances are they'd probably just give everyone the DLC (or face a class action), but that's different than just giving everyone the OVAs...I dont even think Funimation has the OVAs? idk.

Well, at least you tried to be polite in your dismissive marginalization of fan priorities and preferences which don't fall in line with your own. It's better than just posting "Who cares? I don't!" though not by much.

That aside, consider that things like bonus OVAs are never included in streaming rights. So while some fans are likely experiencing a show via streams and may not care, others do, and so there is certainly a priority to be placed on wanting to buy a studio's physical release if said release is announced as including such OVAs. Rather than just illegally downloading them like an entitled brat, too.

The OVAs provide fanservice that was sorely missing from the show itself. And fanservice is an essential part of its universe. It's what buyers and fans want so the expectations are higher for this type of extra.

Anyways, good on Funimation for providing this refund at least.

Only if the false statement was made knowingly [you knew you were saying things that were untrue] or recklessly [you didn't care, you just said whatever you thought would get you the sale]. Honest error just makes the contract voidable, which is to say "since you never actually agreed on exactly what it is you were buying/selling there's no contract and if either of you wish you can unwind the transaction".

Note that there's ample scope for genuine breakdowns in communication here given the number of people involved.

Generally the word "lie" is restricted to deliberate false statements made with the intent that people be deceived; more generally -- including for accidents -- we'd probably use a word like "falsehood" or perhaps be more specific, "accidental misstatements" or similar. This may vary by dialect: I think that there's some north american dialects that use "lie" more broadly. This broadly follows the legal distinction above, although not by anyone's design.

[this is stuff you're supposed to know -- maybe not in so much detail -- by the time you're in middle years of high school, btw. If you're younger than that or you have certain mental/cognitive problems then it's a "oh, I guess I'll have to learn here!" situation, but otherwise... well, it's still a "Oh, I guess I'll have to learn here" situation, just a more-pressing one.]

This whole fiasco is a little disappointing but at least they are trying to fix it.

I plan to keep my copy since I am a fan of the anime version and thought it was pretty good. The real evil here is marvelous entertainment.

if it was like that crap version english only persona 4 I absolutely would mail it back to them.

These are the same people that publish Ichiban ushiro daimaoh that is missing the extras on the sentai blu-ray, as well. I bought it assuming they were included since no one knew and I was furious about it.

The real lesson has always been the same:
do not pre-order anime and do not trust american anime companies.

People saying this is lieing and fraud are overlooking a key point. Both of those imply the intent to deceive, which you really can't prove in any way. It can't be fraud unless Funimation knowingly advertised the false information.

Does it show some level of incompetence on their part? Yes, certainly.
Did they illegally lie to customers with the intent to deceive them? Not that you can prove.

Yes, the real issue seems to lay with the licensor. I can only speculate that there was some kind of misunderstanding or breakdown of the licensing agreement, since Funimation is pretty good and usually tries to include short OVAs (look at their other titles). I was also pissed that Daimao did not include the short OVAs, and since then I've learned that Sentai has been unreliable for those kind of OVAs. It's like 50/50 with them.

Not saying I'd buy Senran Kagura, but surely there are anime you'd like to purchase some time. Now imagine that this sort of scenario happens to them, where you were under the assumption an extra was included and then turned out not to be the case. Are you pleased, angered, indifferent?

As others have mentioned,
It's not quite false advertising. False advertising requires willful deceit to customers from a company to be considered false advertising. As this was an accident and Funi is offering a refund, no false advertising.

Man, I wish a basic law class was mandatory in all school districts, considering it's a citizens duty to be informed of the law. Business Law was one of my most useful classes real glad I took that.
