It's not illegal, though it may be subject to obscenity laws depending on the state the company is it. It can also become a bit of a hassle finding banks and things like paypal to work with for payments since a lot of very much against being involved in any form of adult material, under aged fictional characters or not.
Oh they apply it to manga to some degree. Because of the Tokyo Youth's ordinance to help "clean up" Japan's image for the Olympics ero-manga censorship has gotten a bit stricter, and some can't even sell in the convenience stores anymore. This isn't addressing the loli-con stuff though, just general erotic manga. The publishers and artists in Japan by no means like it. As the Wani Magazine editor FAKKU had at their panel at AX said spoiler[fudge censorship!"] No one in Japan WANTS their stuff censored, it's just the law and they do their best to work around it. And though hentai animation licenses have stalled, FAKKU is branching out on a lot of uncensored manga releases from different publishers, something publishers have previously been unable to do here in the US. Gonna state for clarification I work for FAKKU. |

From reading here & elsewhere, distributing hentai does seem like more hassle than it's worth even if the Japanese license owners are game. One thing I read that doesn't seem to have come up yet is that credit card companies don't want to be involved with hentai distributors, because they think hentai = tentacles & teens = bestiality & child porn. Not worth the risk to them to be snagged by the feds for being involved. That means that even if, by some miracle, you have a product to sell & people wanting to buy, you can't process payments without using some alternative payment system most regular buyers won't be willing to use. I've heard pornstars have similar problems with their bank accounts being frozen because of suspicion they're involved in prostitution.

Strictly speaking, I think it's the current interpretation of the law, rather than actual law. It could probably be argued that the law doesn't apply to drawings (and it didn't at a recent Shunga exhibit in Tokyo AFAIK), but there's little chance of getting the current government or police in Japan to see it that way anytime soon, especially with the current administration. |

I have never had any trouble using a credit card to buy porn on the Internet or locally. It might be different for dedicated hentai video sites, which I have never tried to purchase from, but I think that most of them are not legal. This is the first that I heard of those new Kitty titles. I will check them out. |

Well, a few things to be said about this. First of all, there's nothing inherently sexual about nudity. A character can be naked for symbolic reasons (like the Ghost in the Shell film) or artistic reasons that have zero sexual connotations. However, nudity obviously also CAN be sexualized. It really just depends on the context of the show and scene. Second, believe it or not, even if it were a blatant hardcore sexual hentai involving a 7 year old, it actually would not be ILLEGAL in the US as long as the character is not indistinguishable from an actual child. There was a supreme court case in 2008 (United States v. Williams) where a person was convicted of soliciting/pandering child pornography. They seized his computer and found more images of child pornography, but they were actually digital computer generated images designed to be realistic. Williams was convicted, because of the soliciting, but what about the images that were already on the computer? In this specific case, the court felt that the images could not be distinguished from the real thing. However, the Supreme Court specifically noted that... "....virtual child pornography remained under the protection of the First Amendment, except when it was offered or solicited under the mistaken impression that actual children were depicted." Meaning, as long as the child character in the images/manga/animation is clearly something that is drawn or computer generated and does not closely resemble an actual photograph, then it is actually not illegal in the US. Whether or not that's how it SHOULD be is highly controversial and a matter of personal opinion. |

I just updated it because I got some facts wrong about the case, but yeah it is a really interesting concept, and one with a huge argument both for and against. On one hand, lolicon hentai is the depiction of a child in sexual activity... which is what child pornography IS. On the other hand, it would mean that you could be thrown in prison and labeled as a sexual predator because of a sketch you made on a napkin involving a loli character, which seems like a huge breach of civil rights. I don't even really know how I feel about it, from a legal standpoint. |

I don't know why the uneasiness, law is made to protect the rights of living beings (drawings are things). There is this confusion about liberty of expression was made to protect the things we hold dear, when truth be told it was made to protect the things some people hateth because those are the things in danger of being deleted (albeit many would say they were "purified" chuunibyou much?). |
