Anyway, sounds good. Nice to see some more titles coming over in English, will probably end up buying OtoBoku since I've seen the anime. Did they say whether these are going to be hard releases or DL-to-own? |

Those who say something is illegal but doing it is somehow not illegal, are simply being naive. The intent of all laws are partially or wholly to govern your behavior and place direct limits on your freedom. Does this contradict the U.S. Constitution? Yes, but that's the beauty of it. |

If we forced the US government to follow the constitution in any meaningful way, a good 9/10(or more!) of non-military Federal employees would be out of a job and the USPS would be plunged into bankruptcy from having to deal with competition(the monopoly clause only existed in the Articles of Confederation) and lousy labor contracts.
In any event, establishing a paper trail demonstrating your intent to disseminate pornography to minors is just asking for some bored prosecutor to nail your ass. |

All this topic has reminded me of is how stupid it is that the government believes I am incapable of watching/owning porn when I'm goddamn 16.
I mean, porn is mostly stupid and I could definitely live without it, but still. |

I find it somewhat hilarious that I was able to walk into a Best Buy and buy Strike Witches, which has several nude shots with nipples of underage girls (one of them 12), without any problems.
Yet I cannot buy this game. Oh well, it's not like I lost anything. |

I think I should clarify. It's not illegal because "porn" is not a legal term nor are there any 1st amendment laws specifically regarding or defining it. For one thing, the ratings are all privately assigned, not assigned by law or government. Think about it: Why does youtube put a hard 18+ restriction (meaning it's not just a warning and you can't get around it without registering a fake id) on watching something like Queen's Blade on their official youtube channel when Media Blasters rates it 16+, which it states in big letters right on the back? And how can you watch it uncensored on MB's own site? Who's right and who's wrong? Also what is porn? Is it just tits? No? How about genitals? like: this and this. Oh hey look, amazon even let's you preview this. What about sex? Well there's this .. hmm.. all of them label "erotica" but not porn The same goes for western drawn erotica like this and this as well as Japanese manga/anime like this and the uncut version of Kite -- notice it's "unrated", even though MB has their own rating and most people call it porn. However, the same applies to all the other uncut, not-labeled-as-porn movies that amazon sells--without restrictions--that most consider pornographic are not just unrated by amazon but unrated by the publisher like this and this
Last but not least, why wouldn't Alan Moore's Lost Girls be considered porn when it is far more graphic than Otoboku? How come it was available for anyone to purchase at my local Borders before? In fact, if it were truly and clearly criminal why would Amazon US put themselves up massive liabilities--when they are careful since Amazon JP places restrictions? Or anyone else for that matter like so many websites like sankaku and even popular hosting sites like wordpress and blogger/blogspot (google). Blogger only puts up a content warning, but does not restrict, and neither does wordpress and other hosting sites. That's because there's no law, except for real childporn, that regulates based on specific types of content. That is, there's nothing stating "depicting real or virtual naked people in certain types of ways shall be restricted, while other activities are not". However, the only thing that is unprotected--what most confuse with the legally undefined term "porn"--and thus can be restricted is legal obscenity (i.e. using Miller test). Any general exceptions to the 1st amendment must be predicated on that. All laws that haven't have been struck down, like animenewsnetwork.com/news/2010-09-21/oregon-laws-to-limit-adult-content-from-minors-rejected (and even then, the federal age requirement for interstate commerce of such materials judged to be obscene is actually 16, not 18, by USC title 18 - 1470) However, because legal obscenity itself is NOT defined by specific contents and cannot be judged by oneself or anyone alone based on the material and can only be determined that in the courts 'after the fact', there is no obligation because it is impossible to preemptively determine that (admittedly, some people do themselves, since most laws being irrational, the punishment can be harsh; also, age restrictions may not even matter at all in some state's obscenity laws; this is all truly relative, non-preemptible, based on state, DA, judge, jury and community) |

Porn is short for pornography. Pornography is a legally accepted term that is regulated by a set of laws, that may differ depending on the country. Since there are laws there are also loopholes and requirements. Knowing and using the legal definition of pornography means a business can make and sell works that are or are not legally "porn", at will. |
