Copyright violation is a 1-yr prison crime in Japan. They don't sue you - they turn you into a prison bitch. Laughing

It's a 1-yr prison crime, suspended for 3 years. It's still a 1-yr prison crime worth if he violates his suspension. What's so complicated?

He doesn't go to prison if he doesn't repeat the offense in 3 years.

So... zero year prison crime. Unless you want to say "repeated copyright violation is a 1-yr prison crime in Japan"

I didn't say he's going to prison.......... yet. OK, ya got a point about the "repeated" part. Though the prosecution actually thought that's what the violation is worth, but the judge showed a bit leniency.

(I know what a suspended sentence is. Heck, we make fun of Japan here for having so many suspended sentences, even for serious crimes. A common joke is: kill a man in Japan, you get life - suspended.)

But a suspension still does not change what the crime is worth. First of all, in Japan it's a crime, not a civil case. And it's worth a whole year in prison. For a copyright violation or two. And here, Funimation is just suing for money - they're getting gypped. Laughing

(FWIW, I believe Japan is wrong in this.)

Based on what the article says he would get the prison sentence if he is convicted of ANY crime within 3 years, not just another copyright violation.

You said that he is going to prison for a year in your first post.... and the fact that you had to ask what's so complicated about the sentence shows you really didn't understand what it means.

I hope the uploader's learned his lesson. It would have been awesome if he'd been sentenced to a year of working part-time as an assistant at Sunrise ~ then maybe he'd have a better appreciation for the sheer amount of effort and skill it takes to actually make the kind of works he was so breezily distributing for free. Cool

Man who uploads anime gets caught and sentenced to 1 year of working for the same company that he ripped off.......make a manga about it and I'd buy it Wink

One year of prison time is probably preferable to being sued for tens of thousands of dollars, as the RIAA, MPAA and other organizations would do. A suspended sentence is a much better way of going about this than ruining someone financially over downloading one song, for example.

Um...... no. I said, "Copyright violation is a 1-yr prison crime in Japan. They don't sue you - they turn you into a prison bitch." I'm making a statement on how ridiculous that is. And when I asked, "What's so complicated?" - that was a rhetorical question.

Yeah, a suspended sentence is a bit of leniency, but it still goes on your criminal record that you've been convicted of a crime that is worth a 1-yr prison sentence. It'll show up when you apply for a job or for a loan, etc. You're still treated as a convicted criminal. That's ridiculous.

It should be treated as a civil case, not in criminal court. No criminal records.

When you are caught speeding or not signalling when changing lanes, you broke the law too, but you are not a criminal. Not all broken laws necessarily mean it's a crime.

People shouldn't go to prison for petty crimes like uploading copyrighted videos. Why not just make them pay a fine and get on with it? Save prison space for those criminals that really do need to stay locked up. Saves money yeah?
