This is actually a really important ruling for Anime/Manga fans.
So this will probably squash any chances of Anime/Manga being censored in America. It's too bad the case didn't involve pornographic content, because it would be nice to get a supreme court ruling on that. |

True but mainstream anime and manga were in no danger to begin with, when you look at what passes for daytime and prime time television. It was the pornographic stuff that people were worried about, and if something pornographic is considered obscene it is automatically unprotected by the first amendment. This ruling does not change the unprotected status of obscenity.

Jaymie: You have to contest anime and manga-related cases in court before you can determine it applies to them. And sometimes SCOTUS likes to interpret its own rulings different in different, but similar, situations.

It's nice to see this law get struck down.
While I agree with the idea behind the law, trying to create a government-regulated body for videogames was a bad idea. At least most respectable game stores stick to the ESRB rating system when it comes to sales, similar to how theatres abide by the MPAA ratings system for selling tickets to R rated movies. A win for gamers everywhere. |

I'm always glad when the First Amendment manages to fend off an assault. Unfortunately, all too often I don't think citizens (and elected officials) are capable of differentiating things they don't like from things that should be deemed illegal. Let's go through the first paragraph of the Constitution and see whether this proposed law met muster.
Did this law serve to... establish justice? Not really. insure domestic tranquility? Unlikely. provide for the common defense? No way. promote the general welfare? Hardly. secure the blessings of liberty? Just the opposite, in fact. Nannying isn't governing. |

Not that this is a bad thing, but it still further proof that the Supreme Court is is a smorgasbord of conceit and corruption that will always swing favor to the corporations.
After all, the Walmart fiasco still leaves a bad taste in my mouth. |

I don't get lawmakers sometimes. First off, this law had already been shot down in several other states before, so what did California think would be so special this time? Also, this law is unnecessary because the Video-game industry already regulates itself. Most retailers won't sell M-rated games to minors as well as simply won't carry pornographic games at all. Waste. Of. Time.

true enough but there are still some golden ones through all of the shit that is produced. Moving on from this .. hmm well all I can say though it's still up to the stores on an individual bases to sell games or not to minors "this was part of the case" so I think each store should be responsible for it's own guidelines/content not just one big rule of law that says NO! |
