No, Khara needed to be clearer about the guidelines they wrote instead of being vague and sloppy about them. Or better yet, cut out the middleman and NOT MAKE THEM AT ALL.

So let me get this straight. Khara's getting the backlash for guidelines they set which,in my opinion,seem pretty straightforward (long story short,don't sell fanart of characters that don't belong to you regardless of the rating),and this artist ragequits because s/he can no longer do what s/he wasn't supposed to be doing in the first place.

On their official twitter they have already tried to explain that they are not trying to censor or prohibit anyone from drawing what fans want, and that this guide was just a way to guide fans to something healthy.
But honestly, this is just incredibly stupid, and it's even more stupid when you think that what has been pretty badly accepted can hurt the film.
Let your fans do what they want as long as they don't break any laws, that's the basics they seem to have forgotten.

Are copyright laws not, uh, laws now?

Don't get me wrong, I laughed at Khara's guidelines, but what I think a lot of people are missing is that doujin culture only works with respect on both sides of the field. It's not unheard of for series to have similar guidelines you've never heard of because they haven't been translated into English; this is only getting attention because it's Eva (and the fact the source material does so many of the things they're saying fandom shouldn't).

Fan art is copyright infringement and is breaking the law.
Most companies look the other way because it is seen as a jerk move to prosecute fan creations and because fan creations also work as advertising.

What is bothering you is not the same thing that is bothering other fans. The point you touched is correct, there is nothing wrong with that. The real problem that is causing all this discussion is the studio controlling / imposing limits / recognizing inappropriate themes / not blessing all the freedom of expression that a fan may want to draw. Doujin is part of Japanese culture and pornography is something linked to doujin. By the time the studio withdraws their support for any type of fictional work, many fans have felt betrayed. That is the problem.

Like it or not, they are practically dividing fans between good and bad. A stupid advertising game.

Even copyright laws have exceptions that doujin can fall into as it's generally considered a transformative work.

So no, in this case the rules they're trying to hide behind wont help them.

They're asking people not to profit of sexualizing their characters, because you know. It's Khara's job to oversexualize their characters!

I thought the other annoucement`s discussion thread worked out that the guidelines only apply to the art contest they where running? So why would this effect a doujinshi maker other then grabbing headlines?

Any other artist would have be fine
I truly read the headline and thought: “heh i only hope it’s not mogudan...”
There are a lot of great art of EVA around, but imo the best were his
I want to think that only happened because the studio needs a clean image for the publicity of the new EVA film maybe?
