1. Is that preview image being used for illustrative purposes only? If so, that needs to be clarified. It's not nude so I doubt it's what the guy was arrested for.
2. If the image is for illustrative purposes only, was the artist's permission obtained? 3. Credit the artist in the image. I'm curious why it happened and if it's just a one off case, or start of a crackdown on doujin products (which I think is unlikely). |

If I made a character and she was being used in such a way, even though personally I wouldn't care. My fans would so I would have to act. Though I would tell him don't do it again and take the pillow cause its a nice pillow

This would probably be an interesting case to follow.
The police admitted that he had bought the pillow cover from someone else and then resold it. What would that mean for us, if we bought some anime merchandise at a convention, bought it and then sold it later. But the merchandise was not official merchandise. Would we have violated the law, are we supposed to have some diviner ability to source the material. Though in that person's case it looks like the police were looking at him for other stuff too. |

Love Live in particular has decided to crack down on pornographic content featuring their characters. I'll leave it to someone else to dig up the article, but I believe it was covered here on ANN last year. I'd say if the body pillow were in fact nude, that would constitute being pornographic content. |

Since anime companies usually don't have much in the way of legal departments you can find a lot of anime products being sold at major online stores that are obviously illegal. It is bad enough that for many series the illegal products often outnumber the legal products even on amazon. I can see why the copyright owners dislike that especially when the illegal products are nude body pillows.

1. Yes, illustrative only and I'll clarify that. 2. It's a product image from an online store. Fair use covers that, however if the store is using the image (and selling merchandise) without permission, the artist should definitely be notified. |

If the pillow featured the character completely nude, I'd have figured it would have been because of obscenity laws, but this...? By that logic, why haven't they posed outlaws on both those and doujinshi (and aren't the latter seen as helping show support for a franchise)? Or by that logic, wouldn't someone buying a doujinshi someone sold online count as illegal too? I'm confused...
I never really got the appeal of dakimakuras anyways, nor would I want anyone to make those out of any character I would make. |

I suspect it was the amount of money involved. $27k over 3 years seems larger than just someone selling part or even all their collection, or even what individual doujin circles would make. Say the circles sell their doujins for $5. To match that over three years, they would have to sell 1,850 copies a year, which seems out of reach for an individual circle, both in terms of printing costs and transportation of the materials. As long as doujin circles make very modest profits at best (and likely little to none or less on average) and cracking down would draw a more costly backlash, content creators and publishers in Japan have little incentive to go after the doujin circles. However, a single individual seemingly making a business selling unlicensed goods, especially ones that go against their brand (not that there isn’t a demand, given Love Live regularly ranks highly in number of doujins produced) is another story. It doesn’t really matter if the individual wasn’t the original seller if they are making a suspicious amount of money reselling. |

Comparing this to doujin isn't accurate. Doujin is basically an exception these companies make but still technically not legal. They choose not to act on doujinshi due to the largest positive impact it had. Fanart for profit is not legal - it's a violation of IP laws.

From my understanding Japan's new copyright laws passes for TPP basically outlaws unauthorized work unless it was made for a one time event like an anime convention. So that means no more doujinshi in anime book shops like before. I don't know how things are on the ground but in theory the law outlaws that. So maybe its allowed if its a temporary shop? But if the IP holder really want to crack down they might be able to get them anyways. In any case, I'm of the opinion that most copyright laws are broken in their current form anyways. Not really, you still can find a lot of doujinshi being sell in the shop like Melonbooks and Toranoana. Some even restocked multiple times. I guess things depend on the copyright holder. For example, Kadokawa wants to restrict any doujin merch to be sell in public, while The Pokemon Company basically made any Pokemon doujin works as illegal, except when the doujinka not putting/mentioning any Pocket Monster title on the work. |
