So if you want to create & sell a cosplay outfit and/or prop, you must ask permission from the animation studio first? Does this also mean that before they give you permission to do so, they have to ask you for money as well?

I'm a little confused here. I know in the US, cosplay seems to be a gray area where it seems more like if it stays under the radar, nobody goes after people who sell cosplay costumes. Is this just a case of too much money/too much visibility? Or do Japanese costume-makers have a different relationship with studios?

I think if anyone in the states made 3 million dollars selling bootleg merchandise, "fan grey zone" or not, they'd be in pretty big trouble.

It's also a case of trying to milk a known mainstream franchise in Japan.
This won't be even an issue if this is some two-bit late nite otaku franchise he's trying to milk.

Whenever I find cosplay outfits on websites like eBay, they are usually created in other countries like China and Hong Kong.

As it is now in Japan it's OK to make your own outfit, it's not OK to make a profit counterfeiting and selling copyrighted stuff.

From reading the article, it also seems to be that he may have been passing them off as authentic. Because Bandai sells the Gokaiger jackets and other clothes, and they're very pricy. If he's selling replicas of the official clothing, and implying that they're the official ones, well, that's pretty cut and dry.
