I did not know exactly where to put this. But since when is ANN in the habit of promoting bootlegs? I ask cause they say themselves over in their retailer forum.

Note that we do not permit linking to bootlegs. If you (as a retailer or as a user) posts a link that we believe sells bootleg products, your URL will be replaced with a message like this:
[This URL is a Known Bootlegging website]

However they have up a link to buy from Anime Castle. Last I checked they DO infact sell bootlegged material all over in that site. Granted they carry official on what they can but most of the J-pop soundtracks, Wallscrolls, Posters and various other section are bootlegged. For a while they sold the regionless bootleg advent children till it got closer to time for release. Then they jerked it as to not get caught.
If ANN did some checking they will find this out easily. There are so many known bootleg companies names running wild on that site. So I find this a little odd that being in ANN’s position they are affiliates with anime castle.

Sorry if this is in the wrong place or is not allowed.

ANN had signed an ad space deal with Anime Castle a little bit before they started the bootleg policy. It still earns ANN money, and there'd probably be lots of legal mumbo jumbo if the contract was eliminated now.

So in all likelihood, ANN is probably just going along with the contract, and once it expires, it'll be up to them to renew it or not.

(At least, I think that's what the story was).

I heard the same thing...

1. ANN signs contract with Anime Castle who sells legit DVDs

2. Anime Castle decides to sell Bootlegs

3. ANN can't break contract because it is illegal

ANN should have put in the contract that they will only keep advertising if AC only sold legal material, but it's nothing major. Do what most of us do with bootleg companies, don't buy from there.

That's really a blow for the staff of ANN, not wanting to do something but having to go with it because you're caught in an everbinding legal contract. I'm pretty sure they won't be adv'ing for Anime Castle after the contract. And, come to think of it, this topic came up about 4-5 months ago.

Why #3? I think it's the opposite and they have right to:
4. Legally break contract since Anime Castle is doing something illegal.
or
5. Refund the money to Anime Castle and stop showing the ads.

I don't study law but I'll give my logical reasons to why the contract can't be broken...

If the contract itself didn't say that Anime Castle must continue to sell legitimate merchandise, there is nothing ANN can do. IF the contract stated that the contract will be void if Anime Castle ever sold bootlegs, then the contract would be nullified and the ads would have been removed a long time ago. Does that make sense? I believe, again it's all just logical reasoning since I don't have a copy of the contract, the contract does not state that Anime Castle can't have bootlegs on their site.

A refund could have been offered, but why would Anime Castle do it? They paid money for their ad, and now have an ad in a site devoted to anime which receives a vast amount of traffic. For those people who know that ANN only advertise non-bootleg sites (AC the exception), might think that since ANN has links to Anime Castle, they don't sell bootlegs... I know it's a fallacy but this is what happened to me. I thought Anime Castle was legit until I read a post that was almost exactly like this one.

Instead of speculation (because I've heard many different stories and the situation itself is confusing), I would really like to hear Tempest's comment on this, just to clear the situation.

Anime Castle's contract is up for renewal right now, so we're currently pondering how to best deal with this situation.

Give us a couple days and I'll post a detailed answer in this thread.
