Alright here's the biggest problem with the argument against "Virtual child pornography."
As others have pointed out there are what are considered three types. 1. Real child pornography 2. Virtual child pornography (highly detailed CG or altered images) 3. Hand drawn art of underage (this means 17 and younger) characters performing or involved in sexual acts. 1. Ban the hell out of this, it's wrong and hurts kids. 2. I can see why this is banned, it's been used by defenses in the past claiming real CP was fake because it was "altered". 3. No one is being harmed, why is this being made illegal and a jail time offense? The issue is the bleed over of virtual child pornography. Does this mean that it would effect the 3rd category which is just artwork? If so there's a real problem. To my knowledge, there has been no causal link between exposure to media and then performing the same action in real life barring those with severe mental problems such as socio/psychopathy etc. The only study that showed any kind of positive correlation involved children between the ages of 7-12 and violent video games. That's all. There is no scientific basis for the argument that banning this type of artwork would help protect real children. The ultimate basis for the argument against said artwork is a personal distaste that people find it obscene which is censorship. If someone says that being entertained, aroused, or otherwise enjoying this kind of art means you have intent to do it in real life has an enormous gap of logic. If I like lolicon doujins of an underage individual having sex I will try to do these things in real life. This argument is ridiculous because it's the same train of thought as below. If I like violent video games featuring murder, torture, theft, or vigilante justice I will do these same things in real life and I should therefore be stopped. Therefore if you're not only going to make this material illegal but also make it worthy of jail time do the same thing to every other objectionable fictional media because the basis for removing artwork depicting characters who are 'minors' (arguing for the identity of a cartoon is silly by the way). then why not argue the same penalty applied for violent media involving adults that's also fiction. Hell, films even feature live action representations of violence and that provides less separation from reality and fantasy. Oh, and as another person pointed out this bill is essentially wasting time chasing figments while more immediate threats to the welfare of children exist. Things like the child model industry in japan and other countries. Oh, and starving children, because they're -still- an issue in a lot of countries. Even first world nations. Something even smaller in scale that won't destroy a thriving industry and would be easier to accomplish with the amount of money spent to advertise and politic about this. Abuse in foster care institutions. It's very common for children to be physically abused either violently, sexually, or both while in foster care. |
