This is great news, especially since it's the Ninth Circuit Court, which is over Washington as well. We are very much in an age where black and white definitions of what's acceptable for a certain age group and what's not no longer work. The Saturday Morning Babysitter can no longer be used, and grouping everything as "children's" or "adult's" ignores everything that's in the middle. Parents actually have to be involved in their children's lives, like they were in my generation.

Powells is a fantastic bookstore - it's huge, with a layout that encourages you to roam the stacks. It's good that they were willing to stand up in court over this. Can't think of many others that would.

I love how alot of parents blame retailers for what their children would read. It is the parent's job to make sure their kids read what is deemed appropriate for them. The Content Rating on the back of the books are there for a reason. >.>

But yes, kudos to Powells.

I'm just amused that the judge knew the characters and that his adjective for the scene was so positive. Laughing On a related note, be sure to support the video game voters fight against a similar bill against mature video games.

Yes. It's funny how parents will blame retailers when they should be taking responsibility for their own children and monitor what they read. It's not the bookstore fault if a 12 year old or younger buys, say berserk which is rated M for Mature.

I know right? It's like what I just said above. Parents get upset at bookstores when they should be deeming what is appropriate for their kids. Those parents are like "What? I actually have to take responsibility for my kids?" Rolling Eyes

I'm kind of confused about the laws were, exactly. The "furnishing of obscenity to minors"...wouldn't that be giving books like Berserk to minors? Or is it a law about publishing fiction with minors in obscene situations, or a law about obscenity in comic books?

Just the title description of laws which "Limit Adult Content to Minors" is very hard for me to get my head around.

Either way, this sounds like a victory for free speech.

@einhorn303 I didn't much get the article either, but I don't think they're saying give obscene material to minors, it sounded more like that bookstores can't be responsible if a minor purchases something that is obscene. I'm all for free speech in all, but I never got how obscenity is considered free speech, but whatever. Either way, like I and two people have already said, it's the parents responsibility of what their kids read, they can't blame it on someone else.

The trick, as usual, comes down to interpretation of what is obscene. Basically, they're saying that Berserk isn't obscene because it doesn't have hardcore porn. So I guess they're saying Berserk would be more like an R movie?

I will say that I like that the court told lawmakers that they need to come up with something more specific if they want it to avoid court rejection. Considering how the definition of obscenity varies from person to person and area to area, I think it's important that any law regarding obscenity be as specific as possible.

Exactly.

I can understand it being hard to constantly monitor what your kid is reading, especially in this day and age, but to blame the stores who sell the books? Give me a break. Its their job as a parent to educate their children on what they can and cannot read at their age. Throwing temper tantrums at the book stores solves nothing. Unless the retailers sold pornography to kids they should not be held responsible if a kid happens to buy an R rated manga.

I remember a few years ago this mother blew a gasket at my local comic book retailer because their kid bought a copy of Love Hina. She accused him of selling her son pornography. She then called the police on him to complain that the retailer was selling porn to kids. The next day a cop came into the store. He asked the retailer if he could take a look at the "inappropriate material" as the lady was looking to press charges. He browsed through a few volumes of Love Hina and shook his head with a "Wow, I'm totally wasting my time here." look on his face. After browsing through 2 volumes, he thanked the retailer for his time and left as if he was just a regular customer. No charges were made and my retailer continued to happily sell manga.

If you are truly worried about what kind of books your kids pick up then maybe you should monitor what they are spending their money on or buy the books yourself that are suitable for your children.

Pointing fingers will never solve anything.

Berserk features a "fantastical sex scene between Charlotte and Lord Griffin" but would not "count as hardcore pornography."

Which chapter?
