This. It's all about Twitch now since you can easily circumvent these guidelines through raw donations rather than ad revenue. Hell, you don't even have to play video games anymore. YouTube is so 2015 |

On the Nintendo link, one of the points is "We encourage you to create videos that include your creative input and commentary. Videos and images that contain mere copies of Nintendo Game Content without creative input or commentary are not permitted. You may, however, post gameplay videos and screenshots using Nintendo system features, such as the Capture Button on Nintendo Switch, without additional input or commentary."
"Creative input and commentary" corresponds to the fair use rights and foreign equivalents. At least for the Amer. version, the 4 main points for fair use are somewhat vaguely-worded that the following could occur: a person cites fair use on a work but a court disagrees, even by the SCOTUS. Just because a court interprets a statute to say and mean one thing, they could be wrong. That is, from both practical and legal purposes, the person who correctly interpreted the fair use requirements sometimes could be defendant and their lawyer. However, good luck with finding evidence to where a court, even SCOTUS, admits they were incorrect with that ruling. |

The vague wording is intentional - because it's meant to provide guidelines to be considered rather than ticky-boxes to be checked off. There's too many potential circumstances for a simple set of ticky-boxes to work. |

I really think Nintendo should watch their surveillance on fan art. About as much snarky know it all lowbrow "gamer humor" is schlocky, this could end up being a hotter pot of water Nintendo can fall into if they decide to sterilize anything that "threatens our brand name". And I mean Disney levels of censorship.

Heh, when I found out about this, I decided I should be more vigilant once 2019 hits. I never really liked hearing people talk over the game audio. I prefer if it's in the description, which is what I use it for (and I constasntly bump up against the 5,000-character limit).
I'm probably the sort of uploader they're targeting, which would be a shame as I've been doing this for over a decade: Putting up game footage and expressing my thoughts in the descriptions. It used to be that most people would actually read the description, and the comments that followed would mostly center around that rather than the video. Now I have to frequently tell people who ask questions to read the description because, 80% of the time or more, the answer is in there. |
