Henmaru Machino? I've heard of him and seen some of his material. No offense, but in the realm of hentai manga, Machino can be considered one of the more "extreme" artists, even more so than known loli/shota artists such as the one pen-named "Hindenburg". Now, could something like Machino's work be considered "patently obscene"? Maybe, but as the material is considered to be of a very limited publication, I personally don't feel the obscenity test applies. I mean, it's probably no worse than a dirty book or some of the lemon fan fictions that drift around the Net. Sure, it's not my cup of sake, but that's simply my own judgment; I have no wish to dictate morality in any sense.

While I personally find Machino's work more amusing than anything else, I can understand why it was deemed offensive. At least this guy wasn't put on trial for buying relatively minor stuff like basic hentai.

What? This can't be happening. Christopher should be sentenced to
5 years not 15 years. And Lolicon is not part of a crime. LOLICON ACT of 2009 will be prevent any charge of the current Lolicon status. If the United States Government change Lolicon to Illegal then anime is nothing special anymore and I will never forgive and forget. This is for you ANIMEVICE.COM! |

I think it's sad that because Handley legally bought his copy of the alledged virtual child porn, he gets in trouble.
Meanwhile thousands of people download VCP and get nothing. I mean, this guy could be sentenced rather harshly because he chose to not download. Wow =\ Also, he had no actual CP (per the report), and yet could face a maximum sentence which is greater than what child molestors usually get? Insanity. |

Well, the government does try to keep track (by some sort of fishing) or downloads ... of course, they don't care if you're downloading regular anime/manga ... but if you download something with suspicious tags/titles (i.e. that sounds like kiddie porn), then you can get in trouble if turns out to be ... and apparently that counts for animated stuff now :/ I'm not familiar with this artist, but ... I dunno ... I just can't imagine ANYTHING that is DRAWN that should be considered "obsene." (In the legal sense). |

So...anyone else feel like he got the shaft after reading the plea agreement? Sadly, as I was reading it, I had images of him swallowing the business end of a pistol before sentencing was passed on him, and I don't even know what he looks like! All I read in the agreement just kinda made me angry, especially the part about the agreement being "in the best interest of the public," I believe was how it was put in the document.

At least now we know one of the artists that got him in hot water. This guy is controversial. Edit: Yuck! He has to pay $200,000 within 14 days of signing the plea and that's only the special assessment fee. The money allocated for his defense research by CBLDF is only a drop in the bucket for what he now has to pay. |

I'm not really surprised they'd react so sternly against Machino's works. Only a very small number of people can tolerate his subject matter. If you aren't familiar with them, I urge you to take my word for it and make no further enquiries.

So let me get this straight - the case never went to trial?
If that's true, then this might not be as bad as it seems - things may have gone differently with an actual trial. I can see why he acted the way he did though; by pleading guilty, he avoided an inevitably long trial and the insane costs associated with one. From the sound of it, though, he still got a pretty raw deal :/ |

Well he still has a lot of money to pay and the jail term to be settled out. He prob did the right thing. That special assessment fee was $100,000 per count. His fine for the 2 counts were not included yet. His maximum jail time is 10-15 years. |

Thing is, this has already been going on for 2 years, so much for a "speedy trial" huh?
Also, even if it didn't go to trial all this'll do is make more people wary of getting the stuff legally....go figure...as well as more possibility of such cases popping up as well as less companies in the anime and manga world willing to pick up some titles due to potential risks. Even without a legal precedent, it's gonna cause a stir in the community, even if it's a small one. Remember, the smallest ripple in the ocean can produce a wave of massive proportions~ |

I just can't understand any justification of giving this guy a max jail sentence of 10-15 years. That just sounds beyond absurd As much as everyone wants to say that with this plea bargain he'd save more money in the long time, and can't help but think that if he had let this case go to trial and he had gotten a good dedicated lawyer, there's no way he'd have deemed guilty.

I don't see how this can be a plea deal. He got the maximum jail term he could in the 1st place. This '2 years' was all for not. I don't know any thing about Henmaru Machino but why didn't the Iowa Court get him on the stand or arrested 1st for peddling that type of stuff to people in the USA?
I know also 1st hand what happens when a frame up artist shows up at your door, if they had one of those guys riding on him he probably thinks 15 years is a good deal. It will be about 6 months into the jail deal when Chris snaps and sees what they did to him and theres no recourse unless the courts do something with the Henmaru Machino guy. |
