Aand immediately lost any sympathy from me.

Though it must be stated the drawn images shouldn't count toward any crime no matter how vile they might be, provided of course no real underage models were used...

Completely reasonable sentence, given that real children were involved.

If there were actual, real-life images of child pornography, then the sentence is understandable. But if all 20 images were anime (read: hentai)... Aaargh. Stupid defense system. I won't be surprised if the presiding judge was from the same generation of prunes who claimed in the 60's & 70's that listening to Rock music will cause you to worship Satan, behead cats and do drugs.

BTW, it is written in the source link that the man is 70 years old.

ANN wrote:
Newcombe expressed remorse for his actions. His lawyer Paul Miller had said during the trial that Newcombe came across the images while searching for adult pornography online. Miller added after the sentencing that the moral of this story is "not to go looking because you never know what you may find that will get you in trouble."

No. The moral is: don't bring your fap material to work, don't leave it unlabeled (even a colorful sticker, something), and don't hook it up to a work terminal.

"The defense and prosecution recommended that Newcombe serve the 90-day prison sentence on the weekends" You can do this? That's pretty interesting. Also I found the excuse funny..."Found when looking for adult porn". Then...why did you save it?

Actually, the sentence is extremely light. In fact, 90 days is the absolute minimum, and only available if you plead guilty with no trial. Had he gone to trial, the minimum sentence would have been 6 months, and could have been as much as 5 years.

Criminal Code, RSC 1985, c C-46 wrote:
Accessing child pornography

(4.1) Every person who accesses any child pornography is guilty of

(a) an indictable offence and is liable to imprisonment for a term of not more than five years and to a minimum punishment of imprisonment for a term of six months; or

(b) an offence punishable on summary conviction and is liable to imprisonment for a term of not more than 18 months and to a minimum punishment of imprisonment for a term of 90 days.

often time it will start with something

then it will escalate to something worst

if you have kids, teach them to beware of strangers

some of these freaks are already registered sex offenders but they still can commit the crimes- so it's the parents' job to teach their kids

there's an app to track these guys (the ones in your neighborhood)

or just visit your local police department or places like
https://www.crimereports.com/

they should have the name, address, and face of these sex offenders available to the public.

I'd feel sorry for him if all images were anime. If they are not, then to hell with him. Also, on a related note, who the hell brings porn to work anyway?

I don't sympathize if there were real children among the images. For things like this, it's best to keep your 2D and your 3D separate. Though like a few others in this thread, I wonder what possessed him to bring it to his job. I mean, I'm not sure exactly why you would do that unless you really need that for your work break or something.

I'm not certain if the US does this. In Canada sentences like this are given for a variety of reasons.

It's a way of reducing the harshness of the sentence when the judge feels that even the minimum sentence is harsh.

It can also be given to people who are the principal weekday caregivers for some sort of dependent, or people who are responsible for providing financially for their dependents.

Example: "Okay, you take care of the children during weekdays, and your spouse will take care of them on the weekend while you serve your sentence." Or, "Okay, you work on weekdays to provide for your family (who will not be able to provide for themselves if you don't bring home any money), and serve your sentence on weekends.

Only to non-violent criminals that are not deemed not a threat to the community.

There's also a form of deferred sentence, where the sentence is to be served at a later date. Sometimes this is done so that they can be put on parole immediately, and the sentence might actually be waived if they behave. Overtimes this is done so that they can raise their children till the age of 18, or spend time with a terminally ill family member. Etc...

I know the US does deferred sentences as well.

having address is dangerous. people like to take law into their own hands, and could do something regretful, even if the person is on the path of restoration.

edit: I admit I misunderstood and misread, I still feel its a bit dangerous to have the exact address.

So, which was it? Were there any actual girls involved, or were there not any actual girls involved? "Appear to be" doesn't make the matter definite, and yes, it does matter.

Pretty shoddy bit of reporting, IMO.

It might be due to the defendant's age (70 years old), and what is presumably his first run-in with the law (at least it wasn't stated in the article if he had any prior misconduct).

The headline had me thinking along the lines of "Here we go again." But seeing as how there were actual images involved, well that changes things entirely. Although, having both kinds of images together will give ammo to the "But, what if anime isn't enough for them?" crowd.

You would think it would be pretty clear, unless some of the images were photo-realistic.
