Well, I guess it's illegal to upload classic games... And yep, WinMX is not dead...

WinMX is still in use? IIRC, that was the thing to use after Napster went legit.

I guess with the rise in digital distribution of older content it would make since to start cracking down on people uploading retro games. Otherwise It just strikes me as a little odd that anyone would care that a game that far out of production. (aside from the DS games)

Abandon-ware is still pretty safe, but anything where the original publisher / developer is still in business always carries the risk of someone going after downloaders.
As always, I suspect that there's more than meets the eye here...

Yes, the most shocking thing here is that WinMX still exists. Like holy crap, I thought it died years and years ago.

It did...waaaay back in 2004. The only way you can even use it is to use custom OpenNap servers (i.e. the default ones the last build of the program used were shut down long ago).
