Actually, that "hot coffee lady" didn't win her lawsuit because the cup didn't have a warning on it, but because the coffee was genuinely much, much hotter than it should have been, and that particular McDonald's restaurant not only knew they were keeping their coffee too hot but had been warned about it in the past. Most frivolous lawsuits are thrown out before they ever get to the jury stage.

Was she trying to drink it while driving or just setting it down in the car until later? Because I still think it's her fault for trying to "do something" while driving. If she had waited, it would have cooled down from more-than-usual hot to less-hot-but-still-hot-enough-for-coffee.

IIRC, she put it in her legs and tried to drive away when it spilled.
Regardless, the coffe was at a temperature unsafe for consumption. You shouldn't HAVE to wait.

Yes, I know you shouldn't have to wait. But I would if I decided it was too hot. Still, she was driving. Putting anything like a drink between your legs is outright stupid. (Drink holder!)
