Well at least they were actually committing the crime of modifying and selling the Wii's and not talking about how to preform the mod yourself. Which is also illegal.

Only in Japan. Jailbreaking your iPhone is legal in the States, so I would assume the same holds true to the Wii and any other console.

It's debated whether it is actually legal, given EULA's and all the other bullshit around nowadays. Of course, I think the U.S. is at this time a little less nuts over corporate copyright, but that isn't necessarily true.
Tux Racer is the only way to be free.
That, and Frozen Bubble.

the jailbraking of cellphones is legal and that was a recent ruling it might not aply to all other consumer electronics. I know that Sony has gone after companies and people in the past for mods to get around region locks. There's something annoying about them being able to copyright or trademark hardware like that. it's like we've only played for the right to rent the device or something. Now all the outdated stuff like the NES we can have lots of fun and turn into toasters because they are no longer making those.

hm, I haven't heard about this when I look at Kotaku. Kotaku's Brian Ashcraft usually report on big crime like this, maybe I can show this to him via Twitter.

The day may come when "This hardware is licensed not sold."

I agree with the act of being able to modify something you legally purchased to do whatever I want.
However, I know Nintendo of America was going around doing raids on people selling modchips and offering modchip installation services a while back, so I also think these people should have kept it to themselves or maybe a few close friends, instead of advertising the softmods as a service to 500 people.

Don't assume. The Librarian of Congress and the Copyright Office entertain proposed exemptions to the Digital Millennium Copyright Act’s anti-circumvention provisions only every 3 years. In other words, exemptions are few and far between. So unless explicitly stated, it's not exempt.
Besides, the Wii is so easy to mod anyways. Anybody could just do it. Why buy a pre-modded one for a fee?

Yeah, that's idiot. Consoles make most money from the games not the platform. So doing it is like asking to go to jail, more so if it's Japan because their police got so much spare time.

As long as you keep it to yourself and don't try to make a profit, they could care less what you do.

I don't want to go soapboxing, but I will say that this is part of the reason I am glad to have been a PC user. You can even run emulators to play whatever game you want. No one has to tip toe around when they Modify a PC. Even some Macintosh have expansion slots.

Well, except current gen games, at least.
Though one could play emulators on the PSP and even PS too.
